Prices in the Offer:

LOWCAST Alternative:
When choosing the LOWCAST alternative, there may be changes to the program in the event of unexpected travel issues, delays, or unforeseen time losses. The client will be informed of these inconveniences on-site during the trip.

Accommodation:
The intermediary will seek the most optimal accommodation for the needs of the trip. If the client is not satisfied with the accommodation and requests a higher standard than what was offered and paid for, the difference in cost must be paid by the client on-site, without the right to request a refund from the intermediary.

Meals:
The trip price includes meals in the form of breakfast, lunch, and dinner according to the trip type. The client should verify what is included in their package before booking.

Local Transportation:
The client will use local transportation as determined by the guide and planned in the chosen trip. The client does not have the right to change transportation arrangements unilaterally. If the client decides to travel independently, they assume all risks associated with traveling, and the intermediary does not guarantee quality or assume responsibility for any damages or consequences that may arise from choosing an alternative option.

Guides:
A local guide is included in the trip price and will accompany the clients throughout the trip, providing explanations of points of interest at the destinations. The client can choose a guide from our portal www.europeaninindia.com in the “Guides” section or opt to have a guide assigned during the trip selection. The selected guide is not entitled to any additional side payments for their services, as these are included in the trip price. However, the client may voluntarily tip the guide after the trip if satisfied with their service.

Other Expenses:
All other expenses are the responsibility of the client.

Article I – Introductory Provisions

The General Terms and Conditions (hereinafter referred to as “GTC”) of LeXtom s.r.o., with its registered office at Námestie Osloboditeľov 62/3, Liptovský Mikuláš, 03101, Company ID: 50251015, registered in the Commercial Register of the District Court of Liptovský Mikuláš, Section Sro, Insert No. 65459/B, apply to all projects and services provided by this company, including the project “European in India.” These GTC are an inseparable part of every contract concluded between LeXtom s.r.o. (hereinafter referred to as “LeXtom”) and the client (hereinafter referred to as the “client”), and by entering into this contract, the client expressly agrees to all conditions stated in these GTC.

These GTC apply to all services and projects organized by LeXtom s.r.o., and the service contract is concluded according to Act No. 513/1991 Coll., the Commercial Code, as amended (hereinafter referred to as the “Commercial Code”).

By entering into the contract, the client acknowledges that the services provided by LeXtom s.r.o. are a specific product in view of their nature, method of organization, and conditions of realization. The client undertakes to accept all conditions stated in these GTC, including the possibilities of changes in the program, schedule, routes, and methods of service provision, for reasons beyond LeXtom’s control.

The client agrees that when participating in the “European in India” project, changes in organization, schedule, or other program adjustments may occur. Therefore, LeXtom is not responsible for any damages incurred, and the client is not entitled to a refund for unused services if such changes occur.

Article II – Price of Services and Payment Terms

  1. Price of Services: The price of services provided by LeXtom is a contractual price agreed upon between LeXtom and the client. The price is listed in the current service offer or on the company’s website www.europeaninindia.com (hereinafter referred to as the “website”). The price may be adjusted depending on current conditions and the availability of services.
  2. Inclusions and Exclusions: The price includes all services stated in the service contract unless otherwise agreed. If it is not possible to provide the agreed services in full, LeXtom undertakes to offer an alternative of the same or higher quality.
  3. Payment Terms: Payment terms are agreed upon individually with each client. Unless otherwise agreed, the client is required to pay a deposit of 50% of the total price upon ordering and reserving the selected trip, and the remaining amount no later than 60 days before the start of the services.
  4. Cancellation Fees: In case of cancellation of the ordered service by the client, LeXtom is entitled to charge cancellation fees as specified in Article VI of these GTC.

General Terms and Conditions for the “European in India” Project

Article I – Introductory Provisions and Conclusion of the Travel Contract

  1. Parties to the Travel Contract:
    • LeXtom s.r.o., with its registered office at Námestie Osloboditeľov 62/3, 031 01 Liptovský Mikuláš, Company ID: 50251015, registered in the Commercial Register of the District Court of Liptovský Mikuláš, Section Sro, Insert No. 65459/L (hereinafter referred to as “LeXtom”).
    • Traveler, who is primarily a person who has concluded the travel contract in written or other appropriate form (hereinafter referred to as the “traveler”).
  2. Scope of Validity: These General Terms and Conditions (hereinafter referred to as “GTC”) apply to all trips organized by LeXtom s.r.o. and form an inseparable part of the travel contract concluded by LeXtom with the traveler in accordance with Act No. 170/2018 Coll. on tours, combined travel services, and amendments to certain laws (hereinafter referred to as the “Act on Tours”).
  3. Nature of Trips: The trips organized by LeXtom s.r.o. are tailored to the nature of the destinations to which they are directed and may include specific conditions (e.g., program changes, route changes, accommodation or transportation changes) depending on current circumstances and opportunities in the respective country. The traveler must be aware of these facts and responsible for their physical and health fitness.
  4. Conclusion of the Contract: The travel contract is considered concluded after the acceptance and confirmation of the order by LeXtom s.r.o., and after the payment of the deposit for the trip, or after the full payment of the trip price.

Minors: Persons under the age of 18 may participate in the trip only under the supervision of an adult who bears full responsibility for them throughout the duration of the trip.

Article II – Price of the Trip and Payment Terms

  1. Trip Price:
    • The trip price includes services stated in the travel contract and detailed trip program. It may include accommodation, meals, transportation, entry fees, tour guides, and other agreed services.
    • The price does not include flights to and from the selected destination, other trips outside the contractually agreed services, personal expenses, fees for premium services and services outside the program, insurance, and visas, unless otherwise agreed in the contract.
  2. Payment Terms:
    • Upon entering into the travel contract, the traveler must pay a deposit of 50% of the total trip price unless otherwise agreed. The balance must be paid no later than 60 days before the start of the trip.
    • If the travel contract is concluded within less than 30 days before the start of the trip, the traveler is required to pay 100% of the trip price at the time of booking.
  3. Surcharges and Price Adjustments:
    • The organizer reserves the right to change the trip price if there is an increase in fuel prices, changes in exchange rates, increased taxes or fees by third parties, or due to unforeseen circumstances. Price changes can be applied no later than 14 days before the start of the trip. The traveler will be notified of the change in writing.
    • If the trip price increases by more than 15%, the traveler has the right to withdraw from the contract without cancellation fees and receive a refund of all paid funds.
  4. Cancellation Fees:
    • In case of trip cancellation by the traveler after booking and contract conclusion, the traveler is obliged to pay the following cancellation fees:
      • 60 days or more before departure: 15% of the total trip price.
      • 59 to 30 days before departure: 30% of the total trip price.
      • 29 to 15 days before departure: 50% of the total trip price.
      • 14 days or less before departure: 100% of the total trip price.

Insurance: The trip price does not include travel insurance and trip cancellation insurance. It is recommended that the traveler obtains insurance against trip cancellation and travel insurance, including medical expense insurance abroad, liability insurance, and luggage insurance.

Article III – Rights and Obligations of Tour Participants

  1. Rights of the Traveler:
    • The traveler has the right to:
      • Ensure the provision of services included in the travel contract and trip program in full.
      • Be informed about all relevant facts regarding the trip.
      • Withdraw from the contract before the trip begins under the conditions set out in this contract.
      • File a complaint about defects and shortcomings in the services provided according to the organizer’s complaints procedure.
      • Receive a refund if the organizer cannot fulfill the trip according to the contract’s conditions.
  2. Obligations of the Traveler:
    • The traveler is obliged to:
      • Provide the organizer with all necessary data and documents required for fulfilling the contract (e.g., valid travel documents, visas, health certificates) no later than 30 days before the trip starts, unless otherwise agreed.
      • Pay the total trip price within the agreed period and amount as stated in Article II of this contract.
      • Follow the rules and instructions of the tour organizer, tour guide, and local authorities during the trip.
      • Have mandatory medical insurance for treatment abroad, and it is recommended to have liability insurance and trip cancellation insurance.
      • Not disrupt the trip by their behavior and not endanger the safety of other trip participants.
  3. Rights of the Tour Organizer:
    • The organizer has the right to:
      • Receive full payment for the trip by the deadlines specified in Article II of this contract.
      • Cancel the trip due to force majeure, insufficient number of participants, or other objective reasons. The organizer must inform the traveler of this fact no later than 7 days before the planned start of the trip.
      • Refuse participation of the traveler in the trip if the traveler does not show capability to participate, fails to present the required documents, or fails to pay the trip price.
  4. Obligations of the Tour Organizer:
    • The organizer is obliged to:
      • Provide the traveler with all services included in the travel contract and trip program.
      • Inform the traveler about all essential facts related to the trip.
      • Ensure the safe conduct of the trip and take care of the health and safety of the travelers.
      • Offer alternative solutions if it is not possible to provide the agreed services for reasons beyond the organizer’s control.
      • Handle traveler complaints according to the organizer’s complaints procedure.

Article IV – Changes and Cancellation of the Trip

  1. Changes by the Organizer:
    • The organizer reserves the right to change the program, price, and scope of services before the start of the trip if it is required due to objective circumstances that the organizer could not foresee or influence, such as force majeure, safety reasons, changes in transportation or accommodation conditions, or political and health risks in the destination country.
    • The organizer is obliged to immediately inform the traveler of any changes to the contract and provide a new version of the travel contract. If the changes affect essential elements of the trip (price, date, duration, services), the traveler has the right to withdraw from the contract without cancellation fees and receive a refund of all paid amounts.
  2. Changes by the Traveler:
    • The traveler may request a change to the travel contract (e.g., change of participant name, change of date) in writing or electronically. The organizer will consider the possibility of making the requested changes and inform the traveler of any additional costs and fees associated with the requested changes.
    • If the traveler withdraws from the contract for reasons not caused by the organizer, the cancellation fees stated in Article V of this contract apply.
  3. Trip Cancellation by the Organizer:
    • The organizer may cancel the trip due to force majeure, such as war conflict, terrorist attack, natural disaster, or insufficient number of participants, provided it happens at least 21 days before the start of the trip.
    • If the trip is canceled, the traveler has the right to a full refund within 14 days of the cancellation notice or may choose to join an alternative trip of the same or higher value, if such a trip is available in the organizer’s offer.
  4. Trip Cancellation by the Traveler:
    • The traveler may withdraw from the travel contract at any time before the start of the trip in writing or electronically. The organizer has the right to charge cancellation fees according to the conditions specified in Article V of this contract.
    • The traveler may withdraw from the contract without cancellation fees in the following cases:
      • Changes to essential elements of the contract by the organizer (e.g., change in price by more than 15%).
      • If the tour organizer fails to fulfill its obligations according to the contract and trip program.
      • If a crisis situation arises in the destination country that objectively prevents the realization of the trip and poses an immediate danger to the travelers.

Article V – Cancellation Conditions and Fees

  1. Cancellation Fees in Case of Withdrawal by the Traveler:
    • If the traveler withdraws from the travel contract for reasons other than those stated in Article IV, the organizer has the right to charge the following cancellation fees:
      • Withdrawal more than 60 days before the start of the trip: 10% of the trip price.
      • Withdrawal 59 – 30 days before the start of the trip: 25% of the trip price.
      • Withdrawal 29 – 15 days before the start of the trip: 50% of the trip price.
      • Withdrawal 14 – 7 days before the start of the trip: 75% of the trip price.
      • Withdrawal less than 7 days before the start of the trip: 100% of the trip price.
  2. Exceptions to the Application of Cancellation Fees:
    • If the traveler provides the tour organizer with a replacement (e.g., another participant who will take part in the trip instead of them) and the new person meets all the conditions for participation, cancellation fees will not be applied. The traveler is only required to pay the administrative and legislative costs associated with the name change amounting to 100 EUR per person.
  3. Withdrawal Due to Force Majeure:
    • If the traveler withdraws from the travel contract due to force majeure (e.g., sudden death in the family, war conflict, terrorist attack, natural disaster in the trip destination), cancellation fees will not be applied. The traveler must provide the organizer with evidence of such circumstances and is entitled to a refund of all paid amounts, except for the actual costs incurred by the organizer in securing the trip (e.g., reservation fees, visas, transfers).
  4. Right to Compensation:
    • The traveler is not entitled to a refund of part or the entire trip amount if:
      • The traveler does not arrive at the departure location at the agreed time and date of the trip.
      • The traveler cannot participate in the trip due to incorrect or incomplete travel documents (e.g., missing valid passport, visas).
  5. Organizer’s Right to Withdraw from the Contract:
    • The organizer has the right to withdraw from the contract with the traveler and cancel their participation in the trip if the traveler violates the contract terms or their behavior endangers the safety and smooth running of the trip. In such a case, the traveler is not entitled to a refund of payments made, and the organizer has the right to charge a cancellation fee of 100% of the trip price.

Article VI – Rights and Obligations of Tour Participants

  1. Rights of Tour Participants:
    • The traveler has the right to:
      • Request the provision of services that are part of the travel contract.
      • Obtain accurate and detailed information about the trip program, its duration, and services provided.
      • Communicate their requirements and comments to the organizer no later than 7 days before the trip start date, if they concern the trip program, accommodation, or catering services.
      • Get familiar with contact information for the local representative of the organizer, emergency contact details, or a place where they can address unforeseen events or problems during the trip.
      • Withdraw from the contract in accordance with the conditions set forth in Article V.
      • Request compensation or a refund in case of non-compliance or inadequate delivery of services included in the travel contract.
  2. Obligations of Tour Participants:
    • The traveler is obliged to:
      • Follow the instructions and guidelines of the organizer, guide, or delegate during the entire trip.
      • Comply with the safety and hygiene regulations applicable in the destination.
      • Arrive on time at all agreed departure, meeting, or activity locations according to the trip program.
      • Adhere to local laws and respect the cultural and social norms of the trip destination.
      • Inform the organizer of all facts that may affect their ability to participate in the trip or the quality of the services provided (e.g., health limitations, allergies).
      • Pay for all personal expenses that are not part of the agreed trip services (e.g., minibar, phone calls, dining outside hotels and selected establishments).
  3. Obligations of Tour Participants in Case of Emergency:
    • If an emergency or extraordinary event occurs during the trip (e.g., accident, health issues, loss of documents), the traveler is obliged to immediately contact the organizer’s representative and follow their instructions.
    • The traveler is required to cooperate with the organizer’s representative in resolving the problem, particularly in communication with local authorities, doctors, or other involved parties.
  4. Failure to Fulfill Obligations by the Traveler:
    • If the traveler violates their obligations as stated in this article, the organizer has the right to terminate the traveler’s participation in the trip. In such a case, the traveler is not entitled to a refund of payments made for the trip, nor to any compensation or reimbursement of damages.

Article VII – Rights and Obligations of the Tour Organizer

  1. Rights of the Tour Organizer:
    • The organizer has the right to:
      • Change the trip program, accommodation, or transportation in the case of unforeseen circumstances that are beyond their control (e.g., weather conditions, strikes, transportation restrictions). The organizer commits to inform the participants of these changes as soon as possible and to provide alternative solutions that are as close as possible to the originally agreed conditions.
      • Cancel the trip if the number of registered participants does not reach the minimum capacity, and notify participants no later than 14 days before the planned start of the trip.
      • Claim compensation for damage caused intentionally or negligently by participants to property or facilities used during the trip (e.g., accommodation, transportation, or other services).
      • Exclude a participant from the trip if they repeatedly violate the rules and instructions of the organizer, endanger the health and safety of other participants, or significantly disrupt the trip. In such cases, the participant loses the right to a refund for the trip or any compensation for damages.
  2. Obligations of the Tour Organizer:
    • The organizer is obliged to:
      • Provide all services and activities agreed upon in the travel contract in the required quality and scope.
      • Inform participants about all essential facts related to the trip before its start, including departure instructions, trip route, accommodation information, local laws, and cultural norms.
      • Provide participants with contact information for the local representative, emergency contact details, or a place where they can address unforeseen events or problems during the trip.
      • Handle and resolve participant complaints and grievances according to Article IX.
      • In the case of changes or cancellation of the trip due to force majeure or other unforeseen circumstances, provide participants with an alternative solution of the highest possible quality available.
      • Provide participants with all necessary documents, tickets, vouchers, or other requirements needed to secure services at the destination.
  3. Organizer’s Obligations in Case of Emergency:
    • The organizer is obliged to provide participants with immediate assistance in case of an emergency (e.g., accident, loss of documents, unplanned changes in accommodation or transportation) and make maximum efforts to resolve it.
    • The organizer must inform the relevant local authorities and provide necessary cooperation in resolving extraordinary events.
  4. Liability of the Organizer:
    • The organizer is liable for damages caused by non-compliance or inadequate performance of contractual obligations, unless it is proven that the damage occurred:
      • Due to the actions or omissions of the trip participant.
      • Due to the actions of a third party unrelated to the agreed services, which could not be foreseen or avoided.
      • As a result of unforeseen circumstances or force majeure beyond the organizer’s control.
  5. Right to Change the Trip Price:
    • The organizer has the right to increase the trip price after the contract has been concluded only if there is a change in:
      • Transportation costs (e.g., increase in fuel prices or transfer fees).
      • Taxes, levies, or other mandatory fees related to the provision of services.
      • Exchange rate fluctuations between currencies that directly affect the final price of the trip.
    • The organizer must notify participants of the price change in writing no later than 14 days before the trip starts.

Article VIII – Complaints and Grievances of Tour Participants

  1. Right to File a Complaint:
    • The participant has the right to file a complaint about shortcomings or failure to meet the conditions of the travel contract that occur during the trip. Complaints must be reported without unnecessary delay, preferably during the trip, so that the organizer has the opportunity to provide a remedy on-site.
  2. Complaint Procedure:
    • The participant is required to report the complaint directly to the organizer’s representative or other responsible personnel appointed to handle problems (e.g., tour guide), and it is recommended to submit the complaint in written form for faster and proper resolution of the issue.
    • If the complaint cannot be resolved immediately on-site, the participant has the right to send a written complaint to the organizer no later than 7 days after the trip ends.
  3. Proposed Solutions and Complaint Resolution Timeframes:
    • The organizer commits to provide a response to the participant’s written complaint within 60 days of its receipt, in written form.
    • If the complaint is justified, the organizer will propose a solution to the problem in the form of appropriate compensation (e.g., provision of additional services, discount on a future trip, financial compensation).
  4. Organizer’s Responsibility for Complaint Resolution:
    • The organizer is responsible for handling complaints in accordance with the contractual conditions and applicable legislation. If the complaint is justified, the organizer is obliged to provide the participant with appropriate compensation within 14 days of acknowledging the complaint.
  5. Complaints Regarding Services of Third Parties:
    • The organizer is not liable for deficiencies in services provided by third parties (e.g., local service providers). In case of dissatisfaction with these services, the participant may contact the service provider directly at the location.
  6. Exclusions from the Complaint Process:
    • The participant is not entitled to a complaint or compensation in the following cases:
      • Non-compliance with the trip program due to force majeure (e.g., natural disasters, political unrest, strikes).
      • Changes or cancellations to the trip program that were made based on the participant’s own decision or behavior, which prevented the continuation of the trip.
      • Missing the agreed meeting or transportation time due to not following the organizer’s instructions.
  7. Dispute Resolution:
    • If a mutual agreement cannot be reached between the participant and the organizer regarding the complaint, the participant has the right to contact the competent local court or alternative dispute resolution body authorized to handle the matter.

Article IX – Conditions for Termination of the Contract

  1. Termination of the Contract by the Tour Participant:
    • The participant has the right to terminate the travel contract at any time before the start of the trip. In case of termination, the participant is obliged to inform the tour organizer in writing and pay a contractual penalty (cancellation fee) according to the following schedule:
      • Termination more than 60 days before the start of the trip: 10% of the total trip price.
      • Termination 30 to 59 days before the start of the trip: 30% of the total trip price.
      • Termination 15 to 29 days before the start of the trip: 50% of the total trip price.
      • Termination 7 to 14 days before the start of the trip: 75% of the total trip price.
      • Termination less than 7 days before the start of the trip or failure to attend the trip: 100% of the total trip price.
  2. Termination of the Contract by the Tour Organizer:
    • The organizer has the right to terminate the travel contract for the following reasons:
      • If the participant violates the terms of the contract (e.g., non-payment of the trip price within the specified period).
      • In case of unforeseen circumstances (e.g., force majeure, security risks in the destination country, insufficient number of participants for the trip).
    • The organizer is obliged to inform the participant in writing about the termination of the contract and refund all financial resources that the participant has paid for the trip no later than 14 days after the termination of the contract.
  3. Termination of the Contract Due to Force Majeure:
    • If unforeseen circumstances (force majeure) occur that prevent the trip from being carried out (e.g., armed conflict, natural disasters, strikes, pandemics), both parties have the right to terminate the contract. In this case, the organizer is not obliged to compensate the participant for any damages incurred but must refund all financial resources paid for the trip, except for costs already incurred (e.g., non-refundable fees for airline tickets, accommodation).
  4. Changes to the Contract and Termination:
    • The participant has the right to request a change in the travel participant (e.g., transfer of the contract to a third person), but only with the organizer’s consent and after paying a change fee of 100 EUR.
    • The organizer has the right to change the program or conditions of the trip before it starts if circumstances arise that cannot be influenced. In this case, the organizer is obliged to inform the participants of the trip and provide them with the opportunity to terminate the contract without penalties.
  5. Consequences of Termination of the Contract:
    • If the participant terminates the contract and is entitled to a refund of part or all of the trip price, the organizer is obliged to refund these funds to the participant within 14 days of receiving the termination notice.
    • The participant is not entitled to compensation for damages if they terminate the contract voluntarily or fail to meet the conditions for termination of the contract without contractual penalties.
  6. Absence from the Trip:
    • If the participant does not arrive at the departure location at the agreed time or is unable to participate in the trip for personal reasons, they are not entitled to a refund of the trip price.
  7. Termination of the Contract Based on Individual Conditions:
    • The participant has the option to terminate the contract without penalties if it concerns a change in the contract terms by the organizer that would significantly alter the nature of the trip (e.g., significant change in price, change of destination).

Article X – Final Provisions

  1. Completeness of the Contract:
    • This contract represents the complete agreement between the tour participant and the tour organizer and replaces all previous agreements, negotiations, and communications regarding the subject of this contract. Any changes and amendments to this contract must be made in writing and confirmed by both parties.
  2. Validity of the Contract:
    • This contract becomes valid and effective on the day it is signed by both contracting parties. By signing the contract, the tour participant confirms that they have read all its provisions, understand them, and agree with them.
  3. Dispute Resolution:
    • All disputes arising from this contract or in connection with it, the contracting parties commit to resolving primarily through mutual negotiations and agreement. If no agreement is reached, the dispute will be resolved before the competent court according to the applicable laws of the Slovak Republic.
  4. Protection of Personal Data:
    • The tour organizer commits to protecting the personal data of the tour participants in accordance with Act No. 18/2018 Coll. on Personal Data Protection and the GDPR (EU) 2016/679 regulation. The tour participant agrees to the processing of their personal data for purposes related to the organization and implementation of the trip. Detailed information on the processing of personal data is provided in a separate document “Information on Personal Data Processing.”
  5. Changes to the General Terms and Conditions:
    • The organizer reserves the right to change these general terms and conditions. Changes take effect on the day of their publication on the organizer’s website. In the case of changes that affect already concluded contracts, the organizer commits to informing the tour participants in writing and ensuring that their rights under the contract concluded before the change are not harmed.
  6. Invalidity of Individual Provisions:
    • If any provision of this contract becomes invalid, ineffective, or unenforceable, it does not affect the validity, effectiveness, and enforceability of other provisions of the contract. In such a case, the contracting parties commit to replacing the invalid provision with a new one that most closely matches the original purpose and meaning of the invalid provision.
  7. Interpretation of the Contract:
    • In the case of any ambiguities or interpretative disputes regarding individual provisions of this contract, the interpretation that corresponds to the purpose of this contract and the interests of both contracting parties shall be preferred.
  8. Annexes and Amendments:
    • The annexes and amendments to this contract are an integral part of it and have the same legal weight as the contract itself.
  9. Language of the Contract:
    • This contract is made in Slovak or English. If a translation into another language is required, the Slovak version is decisive and has priority over the translations in case of ambiguities or discrepancies.
  10. Place and Date of Signing the Contract:
  • This contract is signed and concluded in two copies, each contracting party receiving one copy.
